These Terms of Service govern your use of the Callys.ai platform. By creating an account or using our services, you agree to these terms.

1. Acceptance of Terms

These terms are a binding agreement between you and Callys.ai. You must be at least 18 years old to use the service. If you create or use an account on behalf of a business entity, you represent that you are authorized to bind that entity to these terms.

2. Description of Service

Callys.ai provides an AI-powered voice agent that answers business calls 24/7, qualifies leads, books appointments, and handles frequently asked questions. The service integrates with Google Calendar, Vapi.ai, and Stripe. We do not guarantee uninterrupted, error-free, or always available service.

3. User Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of account credentials.
  • If you suspect unauthorized access, notify support@cvidsproductions.net immediately.
  • Unless approved by us, one account is permitted per business entity.

4. Payment and Billing

  • Plans are billed in USD: Starter $88/month, Pro $168/month, and Business $288/month.
  • New paid plans include a 14-day free trial unless otherwise stated.
  • Subscriptions bill monthly and automatically renew until cancelled.
  • Payments are processed securely by Stripe.
  • You may cancel anytime; cancellation takes effect at the end of the current billing period.

5. Free Trial, Upgrades, and Downgrades

During a trial period, you may cancel before the trial ends to avoid charges. If you upgrade or downgrade plans, billing adjustments may apply on a prorated basis according to Stripe billing settings in your account.

6. Acceptable Use

You agree not to use Callys.ai to:

  • Violate laws, regulations, or third-party rights.
  • Transmit fraudulent, deceptive, abusive, or unlawful call content.
  • Attempt to reverse engineer, disrupt, or compromise our infrastructure.
  • Use the service for unauthorized robocalling, spam, or harassment.

7. Third-Party Integrations

Certain features depend on third-party providers such as Vapi.ai, Google Calendar, Stripe, Supabase, OpenAI, Gemini, Deepgram, and Resend. Your use of integrated features may also be subject to those providers' terms and privacy policies.

8. Data and Privacy

We process personal data as described in our Privacy Policy. You are responsible for obtaining any legally required notice and consent from your callers before recording or processing call content in your jurisdiction.

9. Intellectual Property

Callys.ai and its software, branding, and platform design are owned by us and protected by applicable intellectual property laws. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use the service during an active subscription.

10. Service Availability and Disclaimer

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Callys.ai disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Callys.ai will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from use of the service. Our aggregate liability for any claim is limited to the amount paid by you to Callys.ai in the 3 months preceding the claim.

12. Suspension and Termination

We may suspend or terminate accounts that breach these terms, create legal risk, or threaten platform security. You may terminate your account at any time from your billing settings or by contacting support. Sections that by nature should survive termination will continue to apply.

13. Governing Law, Updates, and Contact

These terms are governed by applicable laws in the jurisdiction where Callys.ai operates, without regard to conflict of laws principles. We may update these terms from time to time; material changes will be posted in the dashboard or sent by email with reasonable notice.
